These terms govern the use of Conclave AI (hereinafter, "the service"), provided by Ivan Antonety (tax ID {NIF_PENDIENTE}). By creating an account and using the service, you accept these terms. If you do not agree with any of them, do not use the service.
1. Service description
Conclave AI is an AI-assisted research platform. The user submits queries and the platform generates reports from the coordinated work of several agents based on AI models. The service is provided "as is" and may evolve; we reserve the right to modify features, add new ones or retire those that no longer make sense.
2. User account
To use the service you need an account. You are responsible for the accuracy of the data you provide, for keeping your password secure and for any activity occurring under your account. If you detect unauthorised access, contact us at ivan@antonety.com as soon as possible.
During the beta phase, access is by invitation. Each invitation code is single-use and tied to the first account that redeems it.
3. Credits and usage
The service runs on credits. Each query consumes a specific amount of credits, shown to the user before launch, so that the cost is known and expressly accepted before consumption.
Credits may be acquired via monthly subscription (which grants a fixed amount of credits at the start of each period) or via one-off extra credit packs. Extra packs do not expire as long as the user's account exists, even after cancellation of a subscription.
If a query fails due to causes attributable to the service, we automatically refund the credits consumed. If the query completes successfully, consumed credits are non-refundable and not convertible into money under any circumstance.
4. Subscriptions and billing cycle
Subscriptions are contracted on monthly periods and renew automatically at the end of each period, unless previously cancelled. The charge is made at the time of subscribing (first period) and, thereafter, on the same calendar date each month.
Upon subscribing, you are immediately granted the amount of credits associated with the plan. Those credits are available to consume during the current period. Unused credits at the end of a period do not roll over to the next period: each renewal replaces the subscription balance. Extra packs follow the regime described in clause 3.
If a renewal charge fails (for example, expired or insufficient card), the service is temporarily suspended until the user updates the payment method. After several unsuccessful retries, the subscription is automatically cancelled.
5. Pricing and taxes
Prices shown on the website (/pricing and similar pages) are expressed EXCLUDING VAT. Applicable VAT is calculated and added automatically at checkout based on the country and, where applicable, the tax identification number of the customer. The final amount charged to the customer, including the corresponding VAT, is clearly displayed on the payment screen before confirming the purchase.
For business customers established in the European Union with a valid intra-community VAT number, the reverse charge mechanism may apply in accordance with current tax law.
6. Right of withdrawal (EU consumers)
If you are a consumer resident in the European Union, you have the right to withdraw from the contract without justification within a period of 14 calendar days from the date of contracting (i.e. from the activation of the subscription or the purchase of the extra pack). To exercise this right, write to ivan@antonety.com indicating your intention to withdraw.
Express exception: given that Conclave AI is a digital service of immediate provision, by initiating the first query you expressly accept the start of execution of the service during the withdrawal period and acknowledge that, once the service has been executed wholly or partially (i.e. once credits have been consumed), you lose the right of withdrawal over the part already executed in accordance with article 103.m of Royal Legislative Decree 1/2007.
If you have not consumed any credits and withdraw within the 14-day period, we will refund in full the amount paid within a maximum of 14 days from the request, using the same payment method used in the purchase.
7. Refunds
Outside the EU right of withdrawal described in clause 6, payments made to the service (monthly subscriptions and extra packs) are non-refundable, except in the following cases:
- Undue or duplicate charge due to a technical error attributable to the service: full refund within a maximum of 14 days.
- Unavailability of the service during a prolonged period due to causes attributable to the service: pro-rata refund of the affected period.
To request a refund, write to ivan@antonety.com stating the reason and attaching proof of payment. We will respond within a maximum of 14 days.
8. Subscription cancellation
You may cancel your subscription at any time from your settings page or by writing to ivan@antonety.com. Cancellation takes effect at the end of the current billing period: during the rest of the period already paid, you retain access to the service and to the credits assigned to that subscription. No partial refunds are made for the unused fraction of the current period.
Following cancellation, no further charges will be made. Any extra packs you have acquired remain in your account indefinitely, in accordance with clause 3.
9. Account cancellation
You may request full deletion of your account at any time from the settings page or by writing to ivan@antonety.com. Deletion implies the loss of any unused credit balance (including extra packs) and the erasure of your data in accordance with clause 6 of the privacy policy.
10. Invoicing
Each payment made to the service automatically generates an electronic invoice in accordance with Spanish tax law. The invoice is sent by email to the user and remains available for download in the account settings page. The tax data appearing on the invoice will correspond to that provided by the user at the time of payment.
11. Acceptable use
You agree not to use the service to generate illegal, defamatory, hateful content or content that infringes third-party rights. You also agree not to attempt to access other users' data, not to reverse engineer the service and not to automate its use at scale without our express permission.
We reserve the right to suspend accounts that breach these principles, without giving rise to a refund of any remaining balance.
12. Intellectual property
You retain all rights over the queries you submit. Reports generated by the service may be used freely by you, including for commercial purposes, with the proviso that you are responsible for verifying the information contained in them before acting on it.
The brand, design, code and architecture of Conclave AI are owned by Ivan Antonety.
13. Limitation of liability
AI-generated reports may contain errors, omissions or outdated information. They should not be used as a sole source for critical decisions (legal, medical, financial or any other high-impact domain). You are responsible for verifying the information before acting on it.
To the extent permitted by law, we accept no liability for indirect damages, loss of profit or consequences derived from use of the service. Our maximum liability for any claim is limited to the amount paid by you in the 12 months preceding the event giving rise to the claim.
14. Changes to these terms
We may update these terms to reflect changes in the service or in applicable law. We will notify by email of any substantial change at least 15 days before it takes effect. Continued use of the service after the new terms come into effect implies acceptance.
15. Governing law
These terms are governed by Spanish law. For any dispute, the parties submit to the courts of the controller's domicile, unless consumer protection law provides otherwise.
